1. Acceptance of Terms

By inviting, using, or interacting with the PowerPath bot (“Bot”) or any related services, websites, or applications (“Services”) operated by PowerPath (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Services on behalf of a server, organization, or other entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, you must not use the Bot or the Services.

We may update these Terms from time to time. We will notify users of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Services after such changes constitutes acceptance of the revised Terms.

2. Description of the Service

PowerPath is a Discord bot that provides in-server gameplay features including, but not limited to:

Economy: A virtual currency system (e.g., Bronze, Silver, Gold) and related commands (e.g., balance, daily, weekly, shop, buy, inventory).
Loadouts & Gear: Equipment systems including weapons, armor, and perks that affect power level and win chance in game modes.
Game Modes: Interactive modes such as Raid, Zombies Outbreak, and The Duelist’s Path, where users can risk in-game resources for rewards.
Beta Access: Optional programs for testing new or experimental features.

All in-game currencies, items, and progress are virtual and have no real-world monetary value. We do not guarantee uninterrupted availability of any feature and may add, change, or discontinue features at our discretion.

3. Eligibility and Discord

Use of the Bot requires a valid Discord account and compliance with Discord’s Terms of Service and Community Guidelines. You must be at least 13 years of age (or the minimum age required in your jurisdiction to use Discord) to use the Services. By using the Bot, you confirm that you meet these requirements.

Server administrators who add the Bot are responsible for ensuring that their server’s use of the Bot complies with these Terms and with Discord’s policies.

4. Acceptable Use

You agree to use the Bot and Services only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the Services. You must not:

Use the Bot to harass, abuse, threaten, or harm others.
Attempt to exploit bugs, cheat, use unauthorized automation, or otherwise gain an unfair advantage in game modes or economy.
Use the Bot to spam, advertise unrelated services, or distribute malware.
Reverse-engineer, decompile, or attempt to extract source code or data from the Bot or our infrastructure (except as permitted by applicable law).
Resell, sublicense, or commercially exploit the Bot or Services without our written permission.
Use the Bot in any server that promotes illegal activity, hate speech, or content that violates Discord’s policies.

We reserve the right to suspend or terminate access for users or servers that we reasonably believe have violated these Terms or that pose a risk to the integrity or safety of the Services.

5. Virtual Items and No Real-World Value

All in-game currencies, items, loadouts, and progress are fictional and exist only within the Bot’s systems. They cannot be exchanged for real money or other items of real-world value. We do not guarantee that any virtual item or progress will remain available indefinitely; we may reset, rebalance, or remove features for operational or fairness reasons.

6. Intellectual Property

The Bot, our websites, logos, names, and all related content and materials are owned by PowerPath or our licensors and are protected by copyright, trademark, and other intellectual property laws. You do not acquire any ownership rights by using the Services. You may not copy, modify, distribute, or create derivative works based on our materials without our prior written consent.

7. Disclaimers

THE BOT AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE BOT WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POWERPATH AND ITS OPERATORS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE BOT OR SERVICES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH CASES, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

9. Indemnification

You agree to indemnify, defend, and hold harmless PowerPath and its operators, affiliates, and licensors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any third-party rights.

10. Termination

We may suspend or terminate your access to the Bot or Services at any time, with or without cause or notice. You may stop using the Bot at any time by removing it from your server or ceasing to interact with it. Upon termination, your right to use the Services ceases immediately. Provisions of these Terms that by their nature should survive (including disclaimers, limitation of liability, and indemnification) will survive termination.

11. Governing Law and Disputes

These Terms are governed by the laws of the United States and the state in which PowerPath is operated, without regard to conflict of law principles. Any dispute arising from these Terms or the Services shall be resolved in the courts of that jurisdiction, and you consent to the personal jurisdiction of such courts.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
